Privacy policy for Job applicant
UMS SKELDAR ("Controller" “we” “us” “our”) is committed to safeguarding all personal information we collect from individuals in the course of our business.
This Policy applies to the processing of personal information of Job applicants (“you”, “your”), in connection with our recruitment processes. For handling recruitment and simplifying the hiring process, we use a platform (the “Service”) provided by a service provider (Teamtailor) acting as a Processor.
With this Policy, as part of our commitment to protect your personal data, we would like to inform you about how and why we collect, use and store (process) your personal data, the lawful basis of the processing and your rights in relation to such processing and how you can exercise them.
1. Collection of personal data
We collect and process some or all of the following information about you:
- Personal details (name, surname);
- Contact information (e-mail, postal address, telephone number, social media profile);
- Information that you upload to the Service (CV, reference letters, qualifications, images etc. relating to your employment history, skills and experience);
- Information linked to interviews (information you provide to us in regular interviews and/or video interviews);
- Electronic and physical communication information (e.g., in-and outbound emails, phones conversations);
- Electronic identification data and other internal identifiers (e.g., login information, IP address, online identifiers/cookies, logs and connection time).
If you are unable to provide us with the personal data above, please note that we might not be able to provide you with the Service in its entirety. Also note that we will process all the personal data that you provide us with in relation to the Service. Therefore, please only provide us with necessary information and not with any sensitive personal data. Sensitive personal data is personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a person, data concerning health or data concerning sex life or sexual orientation.
Data we collect from other sources:
- If you apply for a job opening or connect with us through your social media profile, such as LinkedIn, we will collect your personal data from the relevant social media profile and synchronize with the Service;
- We may also receive your personal data from a party who recommends you as a candidate for a specific job opening or for our business in general.
We collect your personal data when:
- You submit your job application to us directly on our career site, or through your social media profile;
- You connect with us in order to be considered for future job applications and receive updates about job openings, either directly on our career site, or through your social media profile;
- You contact any of our employees through the Service;
- You provide information to us in connection with an application process;
- We collect data from third parties, such as LinkedIn and through other public sources. This is referred to as “Sourcing” and is manually performed by our employees or automatically in the Service.
2. Purpose of processing
The purpose of processing personal data through the Service is to identify and hire suitable candidates and to communicate with and assess candidates based on current and/or future recruitment needs. We must therefore collect your personal data so that you can apply for a job or contact us. We only process personal data that is relevant to the recruitment process and the personal data will only be made available to those who need it to fulfil the purpose.
We use information that we collect about you to:
- manage recruiting and application handling;
- determine the suitability of a job applicant’s qualifications;
- maintaining information on the status of your application;
- prepare for and enter into a contractual employment relationship;
- communicate with you about any actual or potential job vacancy.
3. Legal base for processing
The legal base of the processing of personal data is our legitimate interest to simplify and facilitate recruitment, the necessity to take pre-contractual steps at your request (e.g., preparing a contract of employment for you). We collect consent from you to store your data to be able to process it in a present or future recruitment process and to contact you directly about specific future job opportunities. You have the right to withdraw it at any time by contacting us as indicated under section 9.
4. How we protect personal data
UMS SKELDAR has implemented adequate technical and organizational measures to protect your personal data against unauthorized, accidental or unlawful destruction, loss, alteration, misuse, disclosure or access and against all other unlawful forms of processing.
All employees accessing personal information must comply with the internal rules and processes in relation to the processing of your personal information to protect them and ensure their confidentiality. Specifically, we restrict access to personal information about you to employees and service providers on the basis of the “need to know” principle.
5. Disclosure of personal data
We share your data with the provider of the Service and other third party service providers who use it only in accordance with our instructions and as otherwise required by law. We may also share your personal data with authorities to fulfil obligations under law or execute decisions.
We also may share your data in the following circumstances:
Personal Information may be provided where we are required to do so by law (such as, but not limited to a government order or a subpoena, which we will take steps to contest prior to disclosing), or if we believe in good faith that it is reasonably necessary (i) to respond to claims asserted against us or to comply with the legal process (for example, discovery requests, subpoenas or warrants); (ii) to enforce or administer our policies; (iii) for fraud prevention, risk assessment, investigation; or (iv) to protect our rights, property or safety, its users, business partners or members of the general public.
We may disclose personal data to potential buyer, transferee, merger partner or seller and their advisers in connection with an actual or potential transfer or merger, or to acquire a business or enter into a merger with it.
Transfer of data to other countries
In case data is processed in other countries, we take measures in order to guarantee the protection of your data. We only transfer your personal data to countries with legislation which is considered to provide an adequate level of protection, or in absence, we rely on appropriate safeguards (e.g., standard contractual clauses) or another exception provided by local applicable law. 6. How long we store personal data
Your data will be processed as long as it is necessary for the purposes linked to the personal data and we have legal grounds to process your personal data. The personal data processed with consent as legal ground is only processed as long as we have valid consent. Upon your written request to us, your personal data will be deleted.
After completion of a recruitment, there is certain information that we are obliged to save by law. If your personal data is processed by us for this purpose, we will ensure that it is processed only for the purposes stated in the legislation.
7. Cookies
Our career site uses cookies handled from the service provider. You may accept or decline being tracked through these cookies by indicating your preference to the banner that is displayed to you during the first time you visit the career site or through the “Manage Cookies” functionality in the footer of the career pages. 8. Your rights
You have the right to access and obtain information about your personal data that we process. If personal information is incorrect or incomplete, you have the right to request the correction of data.
You have also the rights to object to the processing of personal data, request the erasure of data, restrict the processing of personal data and/or withdraw your consent to the processing where provided (without this withdrawal affecting the lawfulness of any processing that took place prior to the withdrawal).
